1. PREAMBLE

1.1.
These Business Terms and Conditions (hereinafter the “Business Conditions”) of the individual Jana Kapolková, with registered office at Dolní 1503/11, 140 00, Prague - Nusle, Identification No. (IČ): 05280320, entered in the Trade Register in Prague 4 (hereinafter the “Seller”) in compliance with the provisions of Section 1751(1) of Act No. 89/2012, Coll., the Civil Code (hereinafter the “Civil Code”), stipulate the rights and obligations of the parties arising in connection with or on the basis of the purchase agreement concluded between the Seller and another individual (hereinafter the “Purchaser”) through the Seller’s Internet shop (hereinafter the “Purchase Agreement”). The Internet shop is operated by the Seller on the website at the Internet address www.wearnormcode.com (hereinafter the “Website”) through the Website interface (hereinafter the “Shop Web Interface”).

1.2.
The Business Conditions do not apply to events where a person that/who wishes to purchase goods from the Seller is a legal entity or a person that/who, when ordering goods, acts within the framework of its/his/her business activities or within the framework of its independent job performance.

1.3.
The provisions of the Business Conditions in the wording published at the moment when the Seller’s placed an order on the Website always constitute an integral part of the Purchase Agreement and every Purchaser confirms by placing the order their binding force for the contractual relationship established by the Purchase Agreement. The Purchase Agreement and the Business Conditions are prepared in Czech for domestic business deals and in English for other business deals.

1.4.
The Seller may change or supplement the wording of the Business Conditions. Such changes or supplements take force at the moment when they are published on www.wearnormcode.com. This provision is without prejudice to the rights and obligations established during the effective period of the preceding wording of the Business Conditions.
1. ÚVODNÍ USTANOVENÍ

1.1.
Tyto obchodní podmínky (dále jen „obchodní podmínky“) fyzické osoby Jana Kapolková , se sídlem na ul. Dolní 1503/11, 140 00, Praha / Nusle, identifikační číslo: 05280320, zapsané v Živnostenském rejstříku na Praze 4 (dále jen „prodávající“) upravují v souladu s ustanovením § 1751 odst. 1 zákona č. 89/2012 Sb., občanský zákoník (dále jen „občanský zákoník“) vzájemná práva a povinnosti smluvních stran vzniklé v souvislosti nebo na základě kupní smlouvy uzavírané mezi prodávajícím a jinou fyzickou osobou (dále jen „kupující“) prostřednictvím internetového obchodu prodávajícího (dále jen „kupní smlouva“). Internetový obchod je prodávajícím provozován na webové stránce umístěné na internetové adrese www.wearnormcode.com (dále jen „webová stránka“), a to prostřednictvím rozhraní webové stránky (dále jen „webové rozhraní obchodu”).

1.2.
Obchodní podmínky se nevztahují na případy, kdy osoba, která má v úmyslu nakoupit zboží od prodávajícího, je právnickou osobou či osobou, jež jedná při objednávání zboží v rámci své podnikatelské činnosti nebo v rámci svého samostatného výkonu povolání.

1.3.
Ustanovení obchodních podmínek ve znění uveřejněném v okamžiku zaslání objednávky prodávajícím na webové stránce jsou vždy nedílnou součástí kupní smlouvy a každý kupující zasláním objednávky potvrzuje jejich závaznost na kupní smlouvou vzniklý smluvní vztah. Kupní smlouva a obchodní podmínky jsou vyhotoveny v českém jazyce pro tuzemské obchody a v anglickém jazyce pro ostatní obchody.

1.4.
Znění obchodních podmínek může prodávající měnit či doplňovat. Změny nebo doplnění vstupují v platnost okamžikem jejich zveřejnění na www.wearnormcode.com. Tímto ustanovením nejsou dotčena práva a povinnosti vzniklá po dobu účinnosti předchozího znění obchodních podmínek.
2. CONCLUSION OF PURCHASE AGREEMENT

2.1.
All goods presentation placed in the Shop Web Interface is for information purposes and constitutes the Seller’s request for placing an offer by the Purchaser, it does not constitute an offer for the Purchaser to conclude an agreement and the Seller is not obliged to conclude a purchase agreement for such goods.

2.2.
To order goods, the Purchaser fills in the order form in the Shop Web Interface. The order form contains, in particular, the following information:
2.2.1. on the goods ordered (the Purchaser “puts” the ordered goods in the electronic shopping basket of the Shop Web Interface);
2.2.2. on the method of payment of the purchase price of the goods, and data on the requested method of delivery of the goods ordered; and
2.2.3. information on the costs incurred in connection with the goods delivery (hereinafter jointly referred to as the “Order”).

2.3.
Before sending the Order to the Seller, the Purchaser can check and change the data entered by the Purchaser in the Order, with regard to the fact that the Purchaser can ascertain and correct errors occurring when data are entered into the Order. The Purchaser sends the Order to the Seller by clicking the button “Proceed to Payment”. The data stated in the Order will be considered by the Seller as correct. After the Seller receives the Order, the Seller confirms such receipt to the Purchaser by e-mail sent to the Purchaser’s e-mail address stated in the Order (hereinafter the “Purchaser’s E-mail Address”). Such confirmation does not constitute receipt of the Order.

2.4.
Sending the Order is considered as such conduct of the Purchaser which/who undoubtedly identifies the goods ordered, purchase price, the identity of the Purchaser, and method of payment of the purchase price, i.e. it constitutes the Purchaser’s binding proposal for the conclusion of the Purchase Agreement. The validity of the Order is conditional on filling in all obligatory data in the Order form and the Purchaser’s confirmation that it/he/she acquainted itself/himself/herself with these Business Conditions.

2.5.
The contractual relationship is established by delivering the Order acceptance. The Seller sends the acceptance of the Order to the Purchaser to the Purchaser’s E-mail Address.

2.6.
The Seller is always entitled, depending on the character of the Order (amount of goods, amount of the purchase price, assumed transportation costs), to request that the Purchaser additionally confirms the Order (for example in writing or by phone).

2.7.
Where the Seller cannot fulfill any of the requirements stated in the Order, the Seller may send an amended Offer to the Purchaser stating possible variants of the Order and request the Purchaser’s standpoint.

2.8.
An amended offer is considered as a new draft Purchase Agreement and in such a case the Purchase Agreement will be concluded by the Purchaser’s acceptance by an e-mail.

2.9.
The Purchaser agrees that remote communication means will be used when concluding the Purchase Agreement. The costs incurred by the Purchaser when using remote communication means in connection with the conclusion of the Purchase Agreement (costs of the Internet connection or costs of phone calls) are paid by the Purchaser; such costs do not differ from the basic rate.
2. UZAVŘENÍ KUPNÍ SMLOUVY

2.1.
Veškerá prezentace zboží umístěná ve webovém rozhraní obchodu je informativního charakteru, má povahu výzvy prodávajícího k podání nabídky kupujícím, není nabídkou k uzavření smlouvy prodávajícím a prodávající není povinen uzavřít kupní smlouvu ohledně tohoto zboží.

2.2.
Pro objednání zboží vyplní kupující objednávkový formulář ve webovém rozhraní obchodu. Objednávkový formulář obsahuje zejména informace o:
2.2.1. objednávaném zboží (objednávané zboží „vloží” kupující do elektronického nákupního košíku webového rozhraní obchodu),
2.2.2. způsobu úhrady kupní ceny zboží, údaje o požadovaném způsobu doručení objednávaného zboží a
2.2.3. informace o nákladech spojených s dodáním zboží (dále společně jen jako „objednávka”).

2.3.
Před zasláním objednávky prodávajícímu je kupujícímu umožněno zkontrolovat a měnit údaje, které do objednávky kupující vložil, a to i s ohledem na možnost kupujícího zjišťovat a opravovat chyby vzniklé při zadávání dat do objednávky. Objednávku odešle kupující prodávajícímu kliknutím na tlačítko „Proceed to payment “. Údaje uvedené v objednávce jsou prodávajícím považovány za správné. Prodávající po obdržení objednávky toto obdržení kupujícímu potvrdí elektronickou poštou, a to na adresu elektronické pošty kupujícího v objednávce (dále jen „elektronická adresa kupujícího “). Takové potvrzení není přijetím objednávky.

2.4.
Odeslání objednávky se považuje za takové jednání kupujícího, který nepochybným způsobem identifikuje objednávané zboží, kupní cenu, osobu kupujícího, způsob úhrady kupní ceny, tedy je závazným návrhem kupujícího k uzavření kupní smlouvy. Podmínkou platnosti objednávky je vyplnění všech povinných údajů v objednávkovém formuláři a potvrzení kupujícího o tom, že se s těmito obchodními podmínkami seznámil.

2.5.
Smluvní vztah vzniká doručením přijetí objednávky (akceptací). Prodávající zašle přijetí objednávky kupujícímu na adresu elektronické pošty kupujícího.

2.6.
Prodávající je vždy oprávněn v závislosti na charakteru objednávky (množství zboží, výše kupní ceny, předpokládané náklady na dopravu) požádat kupujícího o dodatečné potvrzení objednávky (například písemně či telefonicky).

2.7.
V případě, že některý z požadavků uvedených v objednávce nemůže prodávající splnit, může kupujícímu zaslat pozměněnou nabídku s případným uvedením možných variant objednávky a vyžádá si stanovisko kupujícího.

2.8.
Pozměněná nabídka se považuje za nový návrh kupní smlouvy a kupní smlouva je v takovém případě uzavřena až akceptací kupujícího prostřednictvím elektronické pošty.

2.9.
Kupující souhlasí s použitím komunikačních prostředků na dálku při uzavírání kupní smlouvy. Náklady vzniklé kupujícímu při použití komunikačních prostředků na dálku v souvislosti s uzavřením kupní smlouvy (náklady na internetové připojení, náklady na telefonní hovory) si hradí kupující sám, přičemž tyto náklady se neliší od základní sazby.
3. INFORMATION ON GOODS AND GOODS PRICES; PAYMENT CONDITIONS

3.1.
The Purchaser shall also be obliged to pay to the Seller, together with the purchase price, the agreed amount of the costs of the goods delivery. Unless expressly stated otherwise, the purchase price also includes the costs incurred in connection with the goods delivery.

3.2.
The Seller does not request that the Purchaser makes any advance payment or any other similar payment. This provision is without prejudice to the provisions of Article 3.5 of the Business Conditions regarding the obligation to pay the goods purchase price in advance.

3.3.
In the case of a cash payment or cash on delivery payment, the purchase price is payable upon the receipt of the goods. In the case of an interbank payment to the Seller’s account, the purchase price is payable within five days following the execution of the Purchase Agreement. In the case of an interbank payment, the Purchaser is obliged to state the variable symbol of the payment when paying the goods purchase price. In the case of payment through a payment gateway, the Purchaser shall follow the instructions of the relevant electronic payments provider. In the case of an interbank payment, the Purchaser’s undertaking to pay the purchase price is fulfilled upon the relevant amount is credited to the Seller account.

3.4.
The Seller is entitled to reservation of the title to the goods, including the packaging of the goods, until the moment when the goods purchase price is paid in full, i.e. the Purchaser acquires the title to the goods no earlier than after the goods purchase price is paid in full.

3.5.
The Seller is entitled, in particular where the Purchaser does not additionally confirm the Order (Article 2.6), to request that the purchase price is paid in full before the goods are dispatched to the Purchaser. The provisions of Section 2119(1), the first sentence of the Civil Code does not apply.

3.6.
Any potential discounts on the goods price provided by the Seller to the Purchaser may not be mutually combined.

3.7.
Where it is usual in the course of business or where it is set forth by generally binding legal regulations, the Seller issues a tax document – invoice for the Purchaser for payments made on the basis of the Purchase Agreement. The Seller is not a value-added taxpayer. The invoice is issued by the Seller for the Purchaser after the goods price is paid and sends in the electronic form to the Purchaser by e-mail to the Purchaser’s E-mail Address.
3. INFORMACE O ZBOŽÍ, CENÁCH ZBOŽÍ A PLATEBNÍ PODMÍNKY

3.1.
Společně s kupní cenou je kupující povinen zaplatit prodávajícímu také náklady s dodáním zboží ve smluvené výši. Není-li uvedeno výslovně jinak, rozumí se dále kupní cenou i náklady spojené s dodáním zboží.

3.2.
Prodávající nepožaduje od kupujícího zálohu či jinou obdobnou platbu. Tímto není dotčeno ustanovení čl. 3.5. obchodních podmínek ohledně povinnosti uhradit kupní cenu zboží předem.

3.3.
V případě platby v hotovosti či v případě platby na dobírku je kupní cena splatná při převzetí zboží. V případě bezhotovostní platby na účet prodávajícího je kupní cena splatná do 5 dnů od uzavření kupní smlouvy. V případě bezhotovostní platby je kupující povinen uhrazovat kupní cenu zboží společně s uvedením variabilního symbolu platby. V případě platby prostřednictvím platební brány postupuje kupující podle pokynů příslušného poskytovatele elektronických plateb. V případě bezhotovostní platby je závazek kupujícího uhradit kupní cenu splněn okamžikem připsání příslušné částky na účet prodávajícího.

3.4.
Prodávajícímu svědčí výhrada vlastnického práva ke zboží, včetně obalu zboží, a to až do okamžiku uhrazení kupní ceny zboží v plné výši, tj. kupující nabude vlastnické právo ke zboží až úplným zaplacením kupní ceny zboží.

3.5.
Prodávající je oprávněn, zejména v případě, že ze strany kupujícího nedojde k dodatečnému potvrzení objednávky (čl. 2.6.), požadovat uhrazení celé kupní ceny ještě před odesláním zboží kupujícímu. Ustanovení § 2119 odst. 1 první věta občanského zákoníku se nepoužije.

3.6.
Případné slevy z ceny zboží poskytnuté prodávajícím kupujícímu nelze vzájemně kombinovat.

3.7.
Je-li to v obchodním styku obvyklé nebo je-li tak stanoveno obecně závaznými právními předpisy, vystaví prodávající ohledně plateb prováděných na základě kupní smlouvy kupujícímu daňový doklad – fakturu. Prodávající není plátcem daně z přidané hodnoty. Daňový doklad – fakturu vystaví prodávající kupujícímu po uhrazení ceny zboží a zašle jej v elektronické podobě kupujícímu elektronickou poštou, a to na adresu elektronické pošty kupujícího.
4. RESCISSION OF PURCHASE AGREEMENT

4.1.
The Purchaser is entitled to rescind the Purchase Agreement within fourteen (14) days following the goods takeover (pursuant to Article 4.3); where several kinds of goods or delivery of several parts constitute the subject of the Purchase Agreement, said deadline commences on the date of the takeover of the supply of the last goods. The deadline is considered fulfilled if the Purchaser sends the goods back to the Seller before the expiration of the 14 days deadline from the date when it acquired physical possession of the goods or the last item or part thereof.

4.2.
To rescind the Purchase Agreement, the Purchaser shall use the sample form provided by the Seller at www.wearnormcode.com. The Purchaser may send the rescission of the Purchase Agreement to the Seller’s e-mail address info@wearnormcode.com or to the Seller’s delivery address at Pod Harfou 994/21, Prague 9, postal code 190 00, Czech Republic. The Seller will immediately confirm to the Purchaser that the Seller obtained the form.

4.3.
In the event of the rescission of the Purchase Agreement pursuant to Article 4.1 hereof, the Purchase Agreement will be terminated ex tunc. The goods must be returned by the Purchaser to the Seller at the Purchaser’s costs without undue delay, no later than within fourteen (14) calendar days following the date of sending the notice of rescission of the Purchase Agreement to the Seller.

4.4.
In the event of rescission of the Agreement, the Purchaser shall bear the costs of the transportation of the returned goods back to the Seller, even if the goods cannot be returned due to their character by standard post.

4.5.
Should the Purchaser rescind the Purchase Agreement, the Seller shall return the funds received from the Purchaser (except for the amount representing additional costs of the delivery of the goods incurred as a result of the goods delivery method chosen by the Purchaser other than the cheapest method of the standard delivery of goods offered by the Seller) within 14 days following the rescission of the Purchase Agreement by the Purchaser in the same manner in which the Seller received the same. The Seller, however, reserves the right to defer the return of the purchase price until the goods are returned pursuant to Article 4.7, second sentence.

4.6.
The Purchaser takes into account that should the goods returned by the Purchaser be damaged or partially used, the Seller will be entitled vis-à-vis the Purchaser to receive compensation for damage incurred thereby by the Seller. The Seller is entitled to unilaterally offset its claim to compensation for damage against the Purchaser’s claim for return of the purchase price.

4.7.
Until the goods are taken over by the Purchaser, the Seller is entitled to rescind the Purchase Agreement at any time. In such an event, the Seller shall return the purchase price to the Purchaser without undue delay by interbank transfer to the account designated by the Purchaser.

4.8.
Should a gift be provided to the Purchaser together with the goods, the donation agreement between the Seller and the Purchaser will be concluded with a condition subsequent to the effect that should the Purchaser rescind the Purchase Agreement, the donation agreement will no longer be effective in respect of the gift and the Purchaser shall be obliged to return the gift to the Seller together with the goods.

4.9.
Where the Purchaser paid the funds in cash upon the goods takeover, the Purchaser expressly agrees that the Seller sends the relevant amount to the Purchaser by interbank transfer upon the rescission of the Purchase Agreement.

4.10.
Where the payment was made using a gift voucher, the Purchaser expressly agrees that the financial amount is returned in the form of a credit that will be issued either by the Seller at the shop or that will additionally be sent to the Purchaser’s E-mail Address.
4. ODSTOUPENÍ OD KUPNÍ SMLOUVY

4.1.
Kupující má právo od kupní smlouvy odstoupit, a to do čtrnácti (14) dnů od převzetí zboží (ve smyslu čl. 4.3.), přičemž v případě, že předmětem kupní smlouvy je několik druhů zboží nebo dodání několika částí, běží tato lhůta ode dne převzetí poslední dodávky zboží. Lhůta se považuje za dodrženou, pokud kupující zašle prodávajícímu zboží zpět před uplynutím lhůty 14 dnů ode dne, kdy získal zboží, resp. jeho poslední položku nebo část do fyzického držení.

4.2.
Pro odstoupení od kupní smlouvy kupující využije vzorový formulář poskytovaný prodávajícím na stránce www.wearnormcode.com. Odstoupení od kupní smlouvy může kupující zasílat na adresu elektronické pošty prodávajícího info@wearnormcode.com nebo na doručovací adresu prodávajícího Pod Harfou 994/21, 190 00 Praha 9, ČR. Prodávající bezodkladně potvrdí kupujícímu přijetí formuláře.

4.3.
V případě odstoupení od kupní smlouvy dle čl. 4.1. obchodních podmínek se kupní smlouva od počátku ruší. Zboží musí být kupujícím prodávajícímu vráceno na náklady kupujícího bez zbytečného odkladu, nejpozději do čtrnácti (14) kalendářních dnů od odeslání odstoupení od kupní smlouvy prodávajícímu.

4.4.
V případě odstoupení od smlouvy nese kupující náklady na dopravu vráceného zboží zpět prodávajícímu a to i v tom případě, kdy zboží nemůže být vráceno pro svou povahu obvyklou poštovní cestou.

4.5.
Odstoupí-li kupující od kupní smlouvy, vrátí prodávající peněžní prostředky přijaté od kupujícího (kromě částky, která představuje dodatečné náklady na dodání zboží vzniklé v důsledku kupujícím zvoleného způsobu dodání zboží, který je jiný než nejlevnější způsob standardního dodání zboží nabízený prodávajícím) do 14 dnů od odstoupení od kupní smlouvy kupujícím, a to stejným způsobem, jakým je prodávající od kupujícího přijal. Prodávající si však vyhrazuje právo pozdržet vrácení kupní ceny do doby vrácení zboží ve smyslu čl. 4.7., věta druhá.

4.6.
Kupující bere na vědomí, že pokud zboží vrácené kupujícím bude poškozeno, opotřebeno či částečně spotřebováno, vzniká prodávajícímu vůči kupujícímu nárok na náhradu škody jemu tím vzniklé. Nárok na úhradu vzniklé škody je prodávající oprávněn jednostranně započíst proti nároku kupujícího na vrácení kupní ceny.

4.7.
Do doby převzetí zboží kupujícím je prodávající oprávněn kdykoliv od kupní smlouvy odstoupit. V takovém případě vrátí prodávající kupujícímu kupní cenu bez zbytečného odkladu, a to bezhotovostně na účet určený kupujícím.

4.8.
Je-li společně se zbožím poskytnut kupujícímu dárek, je darovací smlouva mezi prodávajícím a kupujícím uzavřena s rozvazovací podmínkou, že dojde-li k odstoupení od kupní smlouvy kupujícím, pozbývá darovací smlouva ohledně takového dárku účinnosti a kupující je povinen spolu se zbožím prodávajícímu vrátit i poskytnutý dárek.

4.9.
V případě, že kupující uhradil peněžní prostředky hotově při převzetí zboží, kupující výslovně souhlasí, aby mu prodávající při odstoupení od kupní smlouvu odeslal částku bankovním převodem.

4.10.
V případě, že byla úhrada provedena s použitím dárkového poukazu, kupující výslovně souhlasí, aby se vrácení finanční částky provedlo formou kreditu, který mu bude vystaven buď prodejcem na prodejně nebo dodatečně zaslán na emailovou adresu kupujícího.
5. TRANSPORTATION AND DELIVERY OF GOODS

5.1.
The method of goods delivery is determined when the goods are ordered. Where the method of transportation is agreed on the basis of the Purchaser’s special request, the Purchaser shall bear the risk and potential additional costs incurred in connection with such method of transportation.

5.2.
Where the Seller is obliged to deliver the goods pursuant to the Purchase Agreement to the place designated by the Purchaser in the Order, the Purchaser shall be obliged to take over the goods upon the delivery.

5.3.
Where it is necessary on grounds on the part of the Purchaser that the goods are delivered repeatedly or in a manner other than that stated in the Order, the Purchaser shall be obliged to pay the costs incurred with the repeated delivery of the goods or the costs incurred in connection with such another method of delivery.

5.4.
Where the goods are taken over from the carrier the Purchaser shall be obliged to check whether the packaging of the goods is intact, and should any defects be discovered, the Purchaser shall be obliged to immediately inform the carrier of such fact (i.e. the person that delivered the goods from which the Purchaser took over the goods). If the packaging has tampered in any way showing unauthorized penetration into the consignment, the Purchaser does not have to take over the consignment from the carrier. The Purchaser confirms by its signature affixed to the delivery bill or to the confirmation of the goods takeover that the packaging of the consignment containing the goods is intact.

5.5.
The risk of damage to the goods passes to the Purchaser by the takeover of the item; the fact that the Purchaser did not take over the item has the same consequence, even if the Seller allowed that the Purchaser may handle the item and the Purchaser breached the Purchase Agreement by not taking over the goods.

5.6.
Other rights and obligations of the parties during the goods transportation may be stipulated by the Seller’s special delivery conditions if such conditions were issued by the Seller.
5. PŘEPRAVA A DODÁNÍ ZBOŽÍ

5.1.
Způsob doručení zboží se provádí v průběhu objednávání zboží. V případě, že je způsob dopravy smluven na základě zvláštního požadavku kupujícího, nese kupující riziko a případné dodatečné náklady spojené s tímto způsobem dopravy.

5.2.
Je-li prodávající podle kupní smlouvy povinen dodat zboží na místo určené kupujícím v objednávce, je kupující povinen převzít zboží při dodání.

5.3.
V případě, že je z důvodů na straně kupujícího nutno zboží doručovat opakovaně nebo jiným způsobem, než bylo uvedeno v objednávce, je kupující povinen uhradit náklady spojené s opakovaným doručováním zboží, resp. náklady spojené s jiným způsobem doručení.

5.4.
Při převzetí zboží od přepravce je kupující povinen zkontrolovat neporušenost obalů zboží a v případě jakýchkoliv závad toto neprodleně oznámit přepravci (tj. doručovateli zboží, od kterého jej přebírá). V případě shledání porušení obalu svědčícího o neoprávněném vniknutí do zásilky nemusí kupující zásilku od přepravce převzít. Podpisem dodacího listu, resp. potvrzení o převzetí zboží kupující stvrzuje, že obal zásilky obsahující zboží byl neporušen.

5.5.
Nebezpečí škody za zboží přechází na kupujícího převzetím věci; týž následek má, nepřevezme-li kupující věc, ač mu s ní prodávající umožnil nakládat a kupující poruší kupní smlouvu tím, že zboží nepřevezme.

5.6.
Další práva a povinnosti stran při přepravě zboží mohou upravit zvláštní dodací podmínky prodávajícího, jsou-li prodávajícím vydány.
6. RIGHT ARISING FROM DEFECTIVE PERFORMANCE

6.1.
The Purchaser is entitled to exercise the right arising from the defects of the goods discovered within 12 months following the takeover. The Purchaser has no right arising from the defective performance if the Purchaser was aware before the goods takeover that the goods were defective or if the Purchaser itself caused the defect of the goods.

6.2.
The Seller shall be liable vis-à-vis the Purchaser that the sold item complies with the Purchase Agreement. Compliance with the Purchase Agreement means that the quality and use qualities of the sold item correspond with the requirements of the agreement and were described by the Seller, manufacturer, or its representative or expected on the basis of the advertising performed by them, or, as the case may be, that the quality and use qualities are typical of an item of such character, that it corresponds with the requirements of legal regulations, is in the appropriate quantity, size or weight and corresponds with the purpose stated by the Seller for the use of the item or for what the item is typically used.

6.3.
In the event that the goods have a defect that constitutes a significant breach of the purchase agreement and the goods were used, the Purchaser is entitled to request, at its own discretion (i) that the defect is removed by a repair of the goods or (ii) reasonable discount on the purchase price or (iii) rescission of the agreement. Should the goods have a defect the nature of which constitutes a non-significant breach of the agreement, the Purchaser has the right that the defect is removed or to receive a reasonable discount on the purchase price of the goods. The Purchaser, in place of the defect removal, can request a reasonable discount on the purchase price or rescission of the Purchase Agreement, if the Seller fails to remove the defect on time or rejects to remove the defect if the defect cannot be removed, or, as the case may be, if it cannot use the goods due to a repeated occurrence of the defect after the repair or due to a great number of defects.

6.4.
In the case of goods sold at a lower price, the provisions set out in Articles 6.1 and 6.2 of the Business Conditions do not apply to a defect due to which the lower price was agreed, to goods wear and tear caused by their standard use, in the case of used goods to a defect corresponding with the extent of the use or wear and tear of the goods existing upon the takeover thereof by the Purchaser or if it so results from the goods character.

6.5.
The rights arising from the liability for goods defects do not apply in particular to events where the defect or damage arose by: (i) mechanical damaging of the goods; (ii) natural disaster; (iii) demonstrably incorrect use; (iv) use in conflict with the instructions for use or instructions stated on the packaging; (v) use in a way contrary to generally known rules of use; (vi) demonstrably by using under conditions that do not correspond (by their temperature, dustiness, humidity or chemical and mechanical effects) with the environment that is directly determined by the manufacturer or that unambiguously results from the nature of the matter; or (vii) by demonstrably unprofessional operation. The rights from defective performance are exercised by the Purchaser at the Seller at the address set out in Article 6.14. The consumer may raise a complaint at a person appointed by the Seller. Where the complaint is handled by a person appointed by the Seller, such person may only handle the complaint by handing over repaired goods, otherwise, the complaint is referred to the Seller to be handled.

6.6.
The Purchaser shall be obliged to prepare the goods in respect of which the complaint was raised for transportation so that the goods are not damaged during the transportation and is also obliged to mark the goods according to their character (fragile, etc.). The risk of damage to the item shall be borne by the Purchaser until it is delivered to the Seller. The Purchaser shall also be obliged to describe in writing how the defect manifests itself (including the way in which the defect occurred).

6.7.
The Purchaser shall be obliged to deliver the goods in respect of which the complaint was raised to the Seller clean (clothing washed, shoes cleaned but not washed).

6.8.
The Seller shall be obliged to provide written confirmation to the Purchaser on when the Purchaser exercised the right from liability for defects, on the contents of the complaint and on what method of the complaint handling is requested by the Purchaser, as well as a confirmation on the date and method of the complaint handling, including a confirmation that the repair was carried out and the duration thereof, and, as the case may be, a written justification of dismissing the complaint.

6.9.
The Seller or a person authorized by the Seller will decide on the complaint immediately, in complicated cases within three business days. Said period does not include the period that is commensurate to the kind of product or services necessary for a professional assessment of the defect. The complaint, including the defect removal, must be handled without delay, no later than within 30 days following the day when the complaint was raised, unless the Seller and the Purchaser agree on a longer period. Expiration of such period to no avail is considered as a significant breach of the agreement and the Purchaser is entitled to rescind the Purchase Agreement.

6.10.
The Seller shall inform the Purchaser by e-mail of the result of the complaint handling.

6.11.
The moment when the complaint was raised is the moment when the Seller received the goods in respect of which the complaint was raised from the Purchaser together with the demonstration of the Purchaser’s will.

6.12.
Where the goods in respect of which the complaint was raised are sent to the Seller, the date when the complaint was received is the day when the last part of the goods was received by the Seller. The day when the complaint was handled is the day when the Purchaser – consumer was informed by the Seller of the method of handling the complaint.

6.13.
No guarantee or liability for defects beyond the framework of the law may not be applied to any gifts that the Seller provides free of charge to the Purchaser under the Purchase Agreement on other paid-for goods.

6.14.
The mailing address for all complaints and the address where it is possible to raise a complaint and to hand over the goods in respect of which the complaint was raised is: Pod Harfou 994/21, Prague 9, postal code 190 00, Czech Republic.
6. PRÁVA Z VADNÉHO PLNĚNÍ

6.1.
Kupující je oprávněn uplatnit právo z vady zboží, které se na zboží vyskytne v době 12 měsíců od převzetí. Právo z vadného plnění kupujícímu nenáleží, pokud kupující před převzetím zboží věděl, že zboží má vadu nebo vadu zboží sám způsobil.

6.2.
Prodávající odpovídá kupujícímu za to, že prodávaná věc je ve shodě s kupní smlouvou. Shodou s kupní smlouvou se rozumí, že prodávaná věc má jakost a užitné vlastnosti smlouvou požadované, prodávajícím, výrobcem nebo jeho zástupcem popisované, nebo na základě jimi prováděné reklamy očekávané, popřípadě jakost a užitné vlastnosti pro věc takového druhu obvyklé, že odpovídá požadavkům právních předpisů, je v tom odpovídajícím množství, míře nebo hmotnosti a odpovídá účelu, který prodávající pro použití věci uvádí nebo pro který se věc obvykle používá.

6.3.
V případě, že zboží vykazuje vadu, která svou povahou představuje podstatné porušení kupní smlouvy, a jde o věc použitou, je kupující oprávněn žádat dle vlastního uvážení buď (i) odstranění vady opravou zboží nebo (ii) přiměřenou slevu z kupní ceny nebo (iii) odstoupit od smlouvy. Jestliže zboží vykazuje vadu, která svou povahou představuje nepodstatné porušení smlouvy, má kupující právo na odstranění vady, anebo na přiměřenou slevu z kupní ceny zboží. Kupující může namísto odstranění vady požadovat přiměřenou slevu z kupní ceny nebo od kupní smlouvy odstoupit, neodstraní-li prodávající vadu včas nebo ji odmítne odstranit, je-li vada neodstranitelná, popř. pokud nemůže zboží užívat pro opakovaný výskyt vady po opravě nebo větší počet vad.

6.4.
Ustanovení uvedená v čl. 6.1 a 6.2. obchodních podmínek se nepoužijí u zboží prodávaného za nižší cenu na vadu, pro kterou byla nižší cena ujednána, na opotřebení zboží způsobené jeho obvyklým užíváním, u použitého zboží na vadu odpovídající míře používání nebo opotřebení, kterou zboží mělo při převzetí kupujícím, nebo vyplývá-li to z povahy zboží.

6.5.
Práva z odpovědnosti za vady zboží se nevztahují zejména na případy, kdy závada nebo poškození vznikla: (i) mechanickým poškozením zboží, (ii) živelnou katastrofou, (iii) prokazatelně nesprávným užíváním, (iv) užíváním v rozporu s návodem k použití nebo pokyny uvedenými na obalu, (v) užíváním v rozporu s obecně známými pravidly užívání, (vi) prokazatelně používáním v podmínkách, které neodpovídají (svojí teplotou, prašností, vlhkostí, chemickými a mechanickými vlivy prostředí, které je přímo výrobcem určeno nebo které jednoznačně vyplývá z povahy věci, (vii) prokazatelně neodbornou obsluhou. Práva z vadného plnění uplatňuje kupující u prodávajícího na adrese uvedené v čl. 6.14. Spotřebitel může reklamaci uplatnit i u osoby určené prodávajícím. Pokud reklamaci spotřebitele vyřizuje osoba určená prodávajícím, tato může reklamaci vyřídit pouze předáním opraveného zboží, jinak reklamaci postoupí k vyřízení prodávajícímu.

6.6.
Kupující je povinen reklamované zboží připravit k přepravě tak, aby při ní nedošlo k poškození zboží a je také povinen zboží označit dle jeho povahy (křehké atd.). Nebezpečí škody na věci nese až do jejího doručení prodávajícímu kupující. Kupující je povinen současně písemně popsat, jak se vada projevuje (příp. i jak vznikla).

6.7.
Kupující je povinen reklamované zboží dodat prodávajícímu čisté (oděvy vyprané, obuv vyčištěná, naopak ale ne praná).

6.8.
Prodávající je povinen kupujícímu vydat písemné potvrzení o tom, kdy kupující právo z odpovědnosti za vady uplatnil, co je obsahem reklamace a jaký způsob vyřízení reklamace kupující požaduje, jakož i potvrzení o datu a způsobu vyřízení reklamace, včetně potvrzení o provedení opravy a době jejího trvání, případně písemné odůvodnění zamítnutí reklamace.

6.9.
Prodávající nebo jím pověřený pracovník rozhodne o reklamaci ihned, ve složitých případech do tří pracovních dnů. Do této lhůty se nezapočítává doba přiměřená podle druhu výrobku či služby potřebná k odbornému posouzení vady. Reklamace včetně odstranění vady musí být vyřízena bezodkladně, nejpozději do 30 dnů ode dne uplatnění reklamace, pokud se prodávající s kupujícím nedohodne na delší lhůtě. Marné uplynutí této lhůty se považuje za podstatné porušení smlouvy a kupující má právo od kupní smlouvy odstoupit.

6.10.
O výsledku vyřízení reklamace informuje prodávající kupujícího e-mailem.

6.11.
Za okamžik uplatnění reklamace se považuje okamžik, kdy prodávající obdržel od kupujícího reklamované zboží společně s projevem vůle kupujícího.

6.12.
V případě zasílání reklamovaného zboží prodávajícímu se za den přijetí reklamace považuje den obdržení poslední součásti zboží prodávajícím. Za den vyřízení reklamace se považuje den vyrozumění kupujícího – spotřebitele prodávajícím o způsobu vyřízení reklamace.

6.13.
Na dárky, které prodávající poskytuje kupujícímu bezplatně v rámci kupní smlouvy na jiné placené zboží, nelze uplatnit záruku ani odpovědnost za vady nad rámec zákona.

6.14.
Zasílací adresa pro veškeré reklamace a adresa, kde lze uplatnit reklamaci a odevzdat reklamované zboží je: Pod Harfou 994/21, 190 00, Praha 9, Česká Republika.
7. OTHER RIGHTS AND OBLIGATIONS OF THE PARTIES

7.1.
The Purchaser takes into account that the software and other parts constituting the Shop Web Interface (including photographs of the goods offered) are protected by copyright. The Purchaser undertakes to refrain from performing any activities that could enable the Purchaser or any third parties to unrightfully interfere with or unrightfully use the software or any other parts constituting the Shop Web Interface.

7.2.
When using the Shop Web Interface, the Purchaser is not entitled to use any mechanisms, software, or any other procedures that might negatively affect the operation of the Shop Web Interface. The Shop Web Interface may only be used to the extent that does not infringe the rights of the other customers of the Seller and that is in compliance with its purpose.

7.3.
The Seller is not bound in relation to the Purchaser by any code of conduct pursuant to the provisions of Section 1826(1)(e) of the Civil Code.

7.4.
The Purchaser takes into account that the Seller is not liable for any errors occurring as a result of third-party interference with the Website or as a result of using the Website in conflict with its purpose.

7.5.
Consumers’ complaints are handled by the Seller via the electronic address info@wearnormcode.com. The Seller shall send the information on handling the Purchaser’s complaint to the Purchaser’s electronic address.

7.6.
The Seller is authorized to sell the goods on the basis of a Trade Authorization. The inspection of the activities performed under the Trade Licence is performed by the Trade Licensing Office within the framework of its competence. The supervision of personal data protection is performed by the Personal Data Protection Office. The Czech Trade Inspectorate supervises to the specified extent the compliance with Act No. 634/1992, Coll., on the Consumer Protection, as amended.

7.7.
The Purchaser hereby assumes the risk of a change of the circumstances pursuant to Section 1765(2) of the Civil Code.
7. DALŠÍ PRÁVA A POVINNOSTI SMLUVNÍCH STRAN

7.1.
Kupující bere na vědomí, že programové vybavení a další součásti tvořící webové rozhraní obchodu (včetně fotografií nabízeného zboží) jsou chráněny autorským právem. Kupující se zavazuje, že nebude vykonávat žádnou činnost, která by mohla jemu nebo třetím osobám umožnit neoprávněně zasahovat či neoprávněně užít programové vybavení nebo další součásti tvořící webové rozhraní obchodu.

7.2.
Kupující není oprávněn při využívání webového rozhraní obchodu používat mechanismy, programové vybavení nebo jiné postupy, které by mohly mít negativní vliv na provoz webového rozhraní obchodu. Webové rozhraní obchodu je možné užívat jen v rozsahu, který není na úkor práv ostatních zákazníků prodávajícího a který je v souladu s jeho určením.

7.3.
Prodávající není ve vztahu ke kupujícímu vázán žádnými kodexy chování ve smyslu ustanovení § 1826 odst. 1 písm. e) občanského zákoníku.

7.4.
Kupující bere na vědomí, že prodávající nenese odpovědnost za chyby vzniklé v důsledku zásahů třetích osob do webové stránky nebo v důsledku užití webové stránky v rozporu s jejich určením.

7.5.
Vyřizování stížností spotřebitelů zajišťuje prodávající prostřednictvím elektronické adresy info@wearnormcode.com. Informaci o vyřízení stížnosti kupujícího zašle prodávající na elektronickou adresu kupujícího.

7.6.
Prodávající je oprávněn k prodeji zboží na základě živnostenského oprávnění. Živnostenskou kontrolu provádí v rámci své působnosti příslušný živnostenský úřad. Dozor nad oblastí ochrany osobních údajů vykonává Úřad pro ochranu osobních údajů. Česká obchodní inspekce vykonává ve vymezeném rozsahu mimo jiné dozor nad dodržováním zákona č. 634/1992 Sb., o ochraně spotřebitele, ve znění pozdějších předpisů.

7.7.
Kupující tímto přebírá na sebe nebezpečí změny okolností ve smyslu § 1765 odst. 2 občanského zákoníku.
8. DELIVERY

8.1.
Unless agreed otherwise, the parties may deliver all written correspondence by electronic mail to the e-mail address stated by the Purchaser in the Order or to the address stated on the Seller’s Website.

8.2.
A message the takeover of which was rejected by the addressee and which was not collected within the deposit period or which was returned as undeliverable shall also be considered delivered.
8. DORUČOVÁNÍ

8.1.
Nebude-li dohodnuto jinak, smluvní strany si mohou veškerou písemnou korespondenci vzájemně doručovat prostřednictvím elektronické pošty, a to na adresu elektronické pošty uvedenou kupujícím v objednávce, resp. na adresu uvedenou na webové stránce prodávajícího.

8.2.
Za doručené se považuje i oznámení, jehož převzetí bylo adresátem odmítnuto, které nebylo vyzvednuto v úložní době, nebo které se vrátilo jako nedoručitelné.
9. FINAL PROVISIONS

9.1.
If the GoPay payment gateway is used provided by GoPay s.r.o., Planá 67, Planá, postal code 370 01, Czech Republic, Identification No. (IČ): 26046768 or if Zásilkovna service is used provided by Zásilkovna s. r. o., with its registered office at Muchovo náměstí 3624/8, Bratislava, postal code 851 01, Identification No. (IČO): 48136999, the conditions of such service shall be applied; certain transactions may be subject to charge. When using such services, the Purchaser by clicking the button “Proceed to Payment” expresses its consent to such conditions and authorizes the Seller to obtain information (including the data on its payment card) and for the provision thereof by such services provider.

9.2.
Should any provision of these Business Conditions be or become invalid or ineffective, provisions the sense of which is as close as possible to the invalid provisions shall be applied in place of the invalid provisions. The invalidity or ineffectiveness of such provisions shall be without prejudice to the validity of the remaining provisions. Any changes and supplements to the Purchase Agreement or to the Business Conditions must be in writing (the written form is also necessary for communication pursuant to Article 8.1).

9.3.
The Purchase Agreement, including these Business Conditions, shall be archived by the Seller in electronic form and is not available.

9.4.
Should any relationship connected with the use of the Website or a legal relationship established by the Purchase Agreement contain any international (foreign) element, the parties agree that such relationship shall be governed by Czech law. This provision is without prejudice to the consumer’s rights arising from generally binding legal regulations. Potential disputes may also be resolved by an out-of-court settlement.

9.5.
Should any consumer dispute arise between the Seller and the Purchaser (consumer) from the Purchase Agreement and it is impossible to resolve such dispute amicably, the consumer may submit an application for out-of-court settlement of such dispute. Consumer disputes arising from the Purchase Agreement will be resolved extrajudicially by the Czech Trade Inspectorate, with its registered office at Štěpánská 567/15, Prague 2, postal code 120 00, Identification No. (IČ): 000 20 869, Internet address: http://www.coi.cz ČOI. Consumers may also use the online dispute resolution platform established by the European Commission at http://ec.europa.eu/consumers/odr/.

9.6.
The Seller recommends that the Purchaser at first uses the contact address info@wearnormcode.com to resolve a particular situation.
These Business Conditions take effect on 01/09/2021.
9. ZÁVĚREČNÁ USTANOVENÍ

9.1.
V případě využití služby platební brány GoPay, kterou poskytuje společnost GoPay s.r.o., Planá 67, 370 01 Planá, Česká republika, IČ: 26046768 nebo službu Zásilkovna, kterou poskytuje společnost Zásilkovna s. r. o., se sídlem Muchovo náměstí 3624/8, 851 01 Bratislava, IČO: 48136999, na tyto vztahy se použijí podmínky těchto služeb, přičemž některé transakce mohou být zpoplatněny. V případě využití těchto služeb Kliknutím na tlačítko "Proceed to payment" kupující projevuje souhlas s těmito podmínkami a zmocňuje Prodávajícího k získávání informací (včetně údajů o jeho platební kartě) a na jejich poskytnutí provozovatelem těchto služeb.

9.2.
Je-li některé ustanovení obchodních podmínek neplatné nebo neúčinné, nebo se takovým stane, namísto neplatných ustanovení nastoupí ustanovení, jehož smysl se neplatnému ustanovení co nejvíce přibližuje. Neplatností nebo neúčinností takového ustanovení není dotknutá platnost ostatních ustanovení. Změny a doplňky kupní smlouvy či obchodních podmínek vyžadují písemnou formu (písemná forma je zachována i komunikací podle čl. 8.1).

9.3.
Kupní smlouva včetně obchodních podmínek je archivována prodávajícím v elektronické podobě a není přístupná.

9.4.
Pokud vztah související s užitím webové stránky nebo právní vztah založený kupní smlouvou obsahuje mezinárodní (zahraniční) prvek, pak strany sjednávají, že vztah se řídí českým právem. Tímto nejsou dotčena práva spotřebitele vyplývající z obecně závazných právních předpisů. Případné spory lze řešit také mimosoudní cestou.

9.5.
V případě, že dojde mezi prodávajícím a kupujícím (spotřebitelem) ke vzniku spotřebitelského sporu z kupní smlouvy, který se nepodaří vyřešit vzájemnou dohodou, může spotřebitel podat návrh na mimosoudní řešení takového sporu. K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, se sídlem Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, internetová adresa: http://www.coi.cz ČOI. Spotřebitel může využít rovněž platformu pro řešení sporů online, která je zřízena Evropskou komisí na adrese http://ec.europa.eu/consumers/odr/.

9.6.
Prodávající doporučuje kupujícímu pro vyřešení nastalé situace nejdříve využít kontakt info@wearnormcode.com. Tyto obchodní podmínky nabývají účinnosti dne 01/09/2021.
1. PREAMBLE

1.1.
These Business Terms and Conditions (hereinafter the “Business Conditions”) of the individual Ing. arch. Tomáš Lindovský, with hits registered office at Vojtěšská 211/6, 110 00, Prague, Identification No. (IČ): 09127569, entered in the Trade Register in Prague 2 (hereinafter the “Seller”) in compliance with the provisions of Section 1751(1) of Act No. 89/2012, Coll., the Civil Code (hereinafter the “Civil Code”), stipulate the rights and obligations of the parties arising in connection with or on the basis of the purchase agreement concluded between the Seller and another individual (hereinafter the “Purchaser”) through the Seller’s Internet shop (hereinafter the “Purchase Agreement”). The Internet shop is operated by the Seller on the website at the Internet address www.wearnormcode.com (hereinafter the “Website”) through the Website interface (hereinafter the “Shop Web Interface”).

1.2.
The Business Conditions do not apply to events where a person that/who wishes to purchase goods from the Seller is a legal entity or a person that/who, when ordering goods, acts within the framework of its/his/her business activities or within the framework of its independent job performance.

1.3.
The provisions of the Business Conditions in the wording published at the moment when the Seller’s placed an order on the Website always constitute an integral part of the Purchase Agreement and every Purchaser confirms by placing the order their binding force for the contractual relationship established by the Purchase Agreement. The Purchase Agreement and the Business Conditions are prepared in Czech for domestic business deals and in English for other business deals.

1.4.
The Seller may change or supplement the wording of the Business Conditions. Such changes or supplements take force at the moment when they are published on www.wearnormcode.com. This provision is without prejudice to the rights and obligations established during the effective period of the preceding wording of the Business Conditions.
1. ÚVODNÍ USTANOVENÍ

1.1.
Tyto obchodní podmínky (dále jen „obchodní podmínky“) fyzické osoby Ing. arch. Tomáša Lindovského , se sídlem na ul. Vojtěšská 211/6, 110 00, Praha, identifikační číslo: 09127569, zapsané v Živnostenském rejstříku na Praze 2 (dále jen „prodávající“) upravují v souladu s ustanovením § 1751 odst. 1 zákona č. 89/2012 Sb., občanský zákoník (dále jen „občanský zákoník“) vzájemná práva a povinnosti smluvních stran vzniklé v souvislosti nebo na základě kupní smlouvy uzavírané mezi prodávajícím a jinou fyzickou osobou (dále jen „kupující“) prostřednictvím internetového obchodu prodávajícího (dále jen „kupní smlouva“). Internetový obchod je prodávajícím provozován na webové stránce umístěné na internetové adrese www.wearnormcode.com (dále jen „webová stránka“), a to prostřednictvím rozhraní webové stránky (dále jen „webové rozhraní obchodu”).

1.2.
Obchodní podmínky se nevztahují na případy, kdy osoba, která má v úmyslu nakoupit zboží od prodávajícího, je právnickou osobou či osobou, jež jedná při objednávání zboží v rámci své podnikatelské činnosti nebo v rámci svého samostatného výkonu povolání.

1.3.
Ustanovení obchodních podmínek ve znění uveřejněném v okamžiku zaslání objednávky prodávajícím na webové stránce jsou vždy nedílnou součástí kupní smlouvy a každý kupující zasláním objednávky potvrzuje jejich závaznost na kupní smlouvou vzniklý smluvní vztah. Kupní smlouva a obchodní podmínky jsou vyhotoveny v českém jazyce pro tuzemské obchody a v anglickém jazyce pro ostatní obchody.

1.4.
Znění obchodních podmínek může prodávající měnit či doplňovat. Změny nebo doplnění vstupují v platnost okamžikem jejich zveřejnění na www.wearnormcode.com. Tímto ustanovením nejsou dotčena práva a povinnosti vzniklá po dobu účinnosti předchozího znění obchodních podmínek.
2. CONCLUSION OF PURCHASE AGREEMENT

2.1.
All goods presentation placed in the Shop Web Interface is for information purposes and constitutes the Seller’s request for placing an offer by the Purchaser, it does not constitute an offer for the Purchaser to conclude an agreement and the Seller is not obliged to conclude a purchase agreement for such goods.

2.2.
To order goods, the Purchaser fills in the order form in the Shop Web Interface. The order form contains in particular the following information:
2.2.1. on the goods ordered (the Purchaser “puts” the ordered goods in the electronic shopping basket of the Shop Web Interface);
2.2.2. on the method of payment of the purchase price of the goods, and data on the requested method of delivery of the goods ordered; and
2.2.3. information on the costs incurred in connection with the goods delivery (hereinafter jointly referred to as the “Order”).

2.3.
Before sending the Order to the Seller, the Purchaser can check and change the data entered by the Purchaser in the Order, with regard to the fact that the Purchaser can ascertain and correct errors occurring when data are entered into the Order. The Purchaser sends the Order to the Seller by clicking the button “Proceed to Payment”. The data stated in the Order will be considered by the Seller as correct. After the Seller receives the Order, the Seller confirms such receipt to the Purchaser by e-mail sent to the Purchaser’s e-mail address stated in the Order (hereinafter the “Purchaser’s E-mail Address”). Such confirmation does not constitute receipt of the Order.

2.4.
Sending the Order is considered as such conduct of the Purchaser which/who undoubtedly identifies the goods ordered, purchase price, the identity of the Purchaser and method of payment of the purchase price, i.e. it constitutes the Purchaser’s binding proposal for conclusion of the Purchase Agreement. The validity of the Order is conditional on filling in all obligatory data in the Order form and the Purchaser’s confirmation that it/he/she acquinated itself/himself/herself with these Business Conditions.

2.5.
The contractual relationship is established by delivering the Order acceptance. The Seller sends the acceptance of the Order to the Purchaser to the Purchaser’s E-mail Address.

2.6.
The Seller is always entitled, depending on the character of the Order (amount of goods, amount of the purchase price, assumed transportation costs), to request that the Purchaser additionally confirms the Order (for example in writing or by phone).

2.7.
Where the Seller cannot fulfil any of the requirements stated in the Order, the Seller may send an amended Offter to the Purchaser stating possible variants of the Order and request the Purchaser’s standpoint.

2.8.
An amended offer is considered as a new draft Purchase Agreement and in such a case the Purchase Agreement will be concluded by the Purchaser’s acceptance by an e-mail.

2.9.
The Purchaser agrees that remote communication means will be used when concluding the Purchase Agreement. The costs incurred by the Purchaser when using remote communication means in connection with the conclusion of the Purchase Agreement (costs of the Internet connection or costs of phone calls) are paid by the Purchaser; such costs do not differ from the basic rate.
2. UZAVŘENÍ KUPNÍ SMLOUVY

2.1.
Veškerá prezentace zboží umístěná ve webovém rozhraní obchodu je informativního charakteru, má povahu výzvy prodávajícího k podání nabídky kupujícím, není nabídkou k uzavření smlouvy prodávajícím a prodávající není povinen uzavřít kupní smlouvu ohledně tohoto zboží.

2.2.
Pro objednání zboží vyplní kupující objednávkový formulář ve webovém rozhraní obchodu. Objednávkový formulář obsahuje zejména informace o:
2.2.1. objednávaném zboží (objednávané zboží „vloží” kupující do elektronického nákupního košíku webového rozhraní obchodu),
2.2.2. způsobu úhrady kupní ceny zboží, údaje o požadovaném způsobu doručení objednávaného zboží a
2.2.3. informace o nákladech spojených s dodáním zboží (dále společně jen jako „objednávka”).

2.3.
Před zasláním objednávky prodávajícímu je kupujícímu umožněno zkontrolovat a měnit údaje, které do objednávky kupující vložil, a to i s ohledem na možnost kupujícího zjišťovat a opravovat chyby vzniklé při zadávání dat do objednávky. Objednávku odešle kupující prodávajícímu kliknutím na tlačítko „Proceed to payment “. Údaje uvedené v objednávce jsou prodávajícím považovány za správné. Prodávající po obdržení objednávky toto obdržení kupujícímu potvrdí elektronickou poštou, a to na adresu elektronické pošty kupujícího v objednávce (dále jen „elektronická adresa kupujícího “). Takové potvrzení není přijetím objednávky.

2.4.
Odeslání objednávky se považuje za takové jednání kupujícího, který nepochybným způsobem identifikuje objednávané zboží, kupní cenu, osobu kupujícího, způsob úhrady kupní ceny, tedy je závazným návrhem kupujícího k uzavření kupní smlouvy. Podmínkou platnosti objednávky je vyplnění všech povinných údajů v objednávkovém formuláři a potvrzení kupujícího o tom, že se s těmito obchodními podmínkami seznámil.

2.5.
Smluvní vztah vzniká doručením přijetí objednávky (akceptací). Prodávající zašle přijetí objednávky kupujícímu na adresu elektronické pošty kupujícího.

2.6.
Prodávající je vždy oprávněn v závislosti na charakteru objednávky (množství zboží, výše kupní ceny, předpokládané náklady na dopravu) požádat kupujícího o dodatečné potvrzení objednávky (například písemně či telefonicky).

2.7.
V případě, že některý z požadavků uvedených v objednávce nemůže prodávající splnit, může kupujícímu zaslat pozměněnou nabídku s případným uvedením možných variant objednávky a vyžádá si stanovisko kupujícího.

2.8.
Pozměněná nabídka se považuje za nový návrh kupní smlouvy a kupní smlouva je v takovém případě uzavřena až akceptací kupujícího prostřednictvím elektronické pošty.

2.9.
Kupující souhlasí s použitím komunikačních prostředků na dálku při uzavírání kupní smlouvy. Náklady vzniklé kupujícímu při použití komunikačních prostředků na dálku v souvislosti s uzavřením kupní smlouvy (náklady na internetové připojení, náklady na telefonní hovory) si hradí kupující sám, přičemž tyto náklady se neliší od základní sazby.
3. INFORMATION ON GOODS AND GOODS PRICES; PAYMENT CONDITIONS

3.1.
The Purchaser shall also be obliged to pay to the Seller, together with the purchase price, the agreed amout of the costs of the goods delivery. Unless expressly stated otherwise, the purchase price also includes the costs incurred in connection with the goods delivery.

3.2.
The Seller does not request that the Purchaser makes any advance payment or any other similar payment. This provision is without prejudice to the provisions of Article 3.5 of the Business Conditions regarding the obligation to pay the goods purchase price in advance.

3.3.
In the case of a cash payment or cash on delivery payment, the purchase price is payable upon the receipt of the goods. In the case of an interbank payment to the Seller’s account, the purchase price is payable within five days following the execution of the Purchase Agreement. In the case of an interbank payment, the Purchaser is obliged to state the variable symbol of the payment when paying the goods purchase price. In the case of a payment through a payment gateway, the Purchaser shall follow the instructions of the relevant electronic payments provider. In the case of an interbank payment, the Purchaser’s undertaking to pay the purchase price is fulfilled upon the relevant amount is credited to the Seller account.

3.4.
The Seller is entitled to reservation of the title to the goods, including the goods packaging, until the moment when the goods purchase price is paid in full, i.e. the Purchaser acquires the title to the goods no earlier than after the goods purchase price is paid in full.

3.5.
The Seller is entitled, in particular where the Purchaser does not additionally confirm the Order (Article 2.6), to request that the purchase price is paid in full before the goods are dispatched to the Purchaser. The provisions of Section 2119(1), first sentence of the Civil Code does not apply.

3.6.
Any potential discounts on the goods price provided by the Seller to the Purchaser may not be mutually combined.

3.7.
Where it is usual in the course of business or where it is set forth by generally binding legal regulations, the Seller issues a tax document – invoice for the Purchaser for payments made on the basis of the Purchase Agreement. The Seller is not a value-added tax payer. The invoice is issued by the Seller for the Purchaser after the goods price is paid and sends it in the electronic form to the Purchaser by e-mail to the Purchaser’s E-mail Address.
3. INFORMACE O ZBOŽÍ, CENÁCH ZBOŽÍ A PLATEBNÍ PODMÍNKY

3.1.
Společně s kupní cenou je kupující povinen zaplatit prodávajícímu také náklady s dodáním zboží ve smluvené výši. Není-li uvedeno výslovně jinak, rozumí se dále kupní cenou i náklady spojené s dodáním zboží.

3.2.
Prodávající nepožaduje od kupujícího zálohu či jinou obdobnou platbu. Tímto není dotčeno ustanovení čl. 3.5. obchodních podmínek ohledně povinnosti uhradit kupní cenu zboží předem.

3.3.
V případě platby v hotovosti či v případě platby na dobírku je kupní cena splatná při převzetí zboží. V případě bezhotovostní platby na účet prodávajícího je kupní cena splatná do 5 dnů od uzavření kupní smlouvy. V případě bezhotovostní platby je kupující povinen uhrazovat kupní cenu zboží společně s uvedením variabilního symbolu platby. V případě platby prostřednictvím platební brány postupuje kupující podle pokynů příslušného poskytovatele elektronických plateb. V případě bezhotovostní platby je závazek kupujícího uhradit kupní cenu splněn okamžikem připsání příslušné částky na účet prodávajícího.

3.4.
Prodávajícímu svědčí výhrada vlastnického práva ke zboží, včetně obalu zboží, a to až do okamžiku uhrazení kupní ceny zboží v plné výši, tj. kupující nabude vlastnické právo ke zboží až úplným zaplacením kupní ceny zboží.

3.5.
Prodávající je oprávněn, zejména v případě, že ze strany kupujícího nedojde k dodatečnému potvrzení objednávky (čl. 2.6.), požadovat uhrazení celé kupní ceny ještě před odesláním zboží kupujícímu. Ustanovení § 2119 odst. 1 první věta občanského zákoníku se nepoužije.

3.6.
Případné slevy z ceny zboží poskytnuté prodávajícím kupujícímu nelze vzájemně kombinovat.

3.7.
Je-li to v obchodním styku obvyklé nebo je-li tak stanoveno obecně závaznými právními předpisy, vystaví prodávající ohledně plateb prováděných na základě kupní smlouvy kupujícímu daňový doklad – fakturu. Prodávající není plátcem daně z přidané hodnoty. Daňový doklad – fakturu vystaví prodávající kupujícímu po uhrazení ceny zboží a zašle jej v elektronické podobě kupujícímu elektronickou poštou, a to na adresu elektronické pošty kupujícího.
4. RESCISSION OF PURCHASE AGREEMENT

4.1.
The Purchaser is entitled to rescind the Purchase Agreement within fourteen (14) days following the goods takeover (pursuant to Article 4.3); where several kinds of goods or delivery of several parts constitute the subject of the Purchase Agreement, said deadline commences on the date of the takeover of the last goods supply. The deadline is considered fulfilled if the Purchaser sends the goods back to the Seller before expiration of the 14 days deadline from the date when it acquired physical possession of the goods or the last item or part thereof.

4.2.
To rescind the Purchase Agreement, the Purchaser shall use the sample form provided by the Seller at www.wearnormcode.com. The Purchaser may send the rescission of the Purchase Agreement to the Seller’s e-mail address info@wearnormcode.com or to the Seller’s delivery address at Pod Harfou 994/21, Prague 9, postal code 190 00, Czech Republic. The Seller will immediately confirm to the Purchaser that the Seller obtained the form.

4.3.
In the event of the rescission of the Purchase Agreement pursuant to Article 4.1 hereof, the Purchase Agreement will be terminated ex tunc. The goods must be returned by the Purchaser to the Seller at the Purchaser’s costs without undue delay, no later than within fourteen (14) calendar days following the date of sending the notice of rescission of the Purchase Agreement to the Seller.

4.4.
In the event of rescission of the Agreement, the Purchaser shall bear the costs of the transportation of the returned goods back to the Seller, even if the goods cannot be returned due to their character by standard post.

4.5.
Should the Purchaser rescind the Purchase Agreement, the Seller shall return the funds received from the Purchaser (except for the amount representing additional costs of the delivery of the goods incurred as a result of the goods delivery method chosen by the Purchaser other than the cheapest method of standard delivery of goods offered by the Seller) within 14 days following the rescission of the Purchase Agreement by the Purchaser in the same manner in which the Seller received the same. The Seller, however, reserves the right to defer the return of the purchase price until the goods are returned pursuant to Article 4.7, second sentence.

4.6.
The Purchaser takes into account that should the goods returned by the Purchaser be damaged or partially used, the Seller’s will be entitled vis-à-vis the Purchaser to receive compensation for damage incurred thereby by the Seller. The Seller is entitled to unilaterally offset its claim to compensation for damage against the Purchaser’s claim for return of the purchase price.

4.7.
Until the goods are taken over by the Purchaser, the Seller is entitled to rescind the Purchase Agreement at any time. In such an event, the Seller shall return the purchase price to the Purchaser without undue delay by interbank transfer to the account designated by the Purchaser.

4.8.
Should a gift be provided to the Purchaser together with the goods, the donation agreement between the Seller and the Purchaser will be concluded with a condition subsequent to the effect that should the Purchaser rescind the Purchase Agreement, the donation agreement will no longer be effective in respect of the gift and the Purchaser shall be obliged to return the gift to the Seller together with the goods.

4.9.
Where the Purchaser paid the funds in cash upon the goods takeover, the Purchaser expressly agrees that the Seller sends the relevant amount to the Purchaser by interbank transfer upon the rescission of the Purchase Agreement.

4.10.
Where the payment was made using a gift voucher, the Purchaser expressly agrees that the financial amount is returned in the form of a credit that will be issued either by the Seller at the shop or that will additionally be sent to the Purchaser’s E-mail Address.
4. ODSTOUPENÍ OD KUPNÍ SMLOUVY

4.1.
Kupující má právo od kupní smlouvy odstoupit, a to do čtrnácti (14) dnů od převzetí zboží (ve smyslu čl. 4.3.), přičemž v případě, že předmětem kupní smlouvy je několik druhů zboží nebo dodání několika částí, běží tato lhůta ode dne převzetí poslední dodávky zboží. Lhůta se považuje za dodrženou, pokud kupující zašle prodávajícímu zboží zpět před uplynutím lhůty 14 dnů ode dne, kdy získal zboží, resp. jeho poslední položku nebo část do fyzického držení.

4.2.
Pro odstoupení od kupní smlouvy kupující využije vzorový formulář poskytovaný prodávajícím na stránce www.wearnormcode.com. Odstoupení od kupní smlouvy může kupující zasílat na adresu elektronické pošty prodávajícího info@wearnormcode.com nebo na doručovací adresu prodávajícího Pod Harfou 994/21, 190 00 Praha 9, ČR. Prodávající bezodkladně potvrdí kupujícímu přijetí formuláře.

4.3.
V případě odstoupení od kupní smlouvy dle čl. 4.1. obchodních podmínek se kupní smlouva od počátku ruší. Zboží musí být kupujícím prodávajícímu vráceno na náklady kupujícího bez zbytečného odkladu, nejpozději do čtrnácti (14) kalendářních dnů od odeslání odstoupení od kupní smlouvy prodávajícímu.

4.4.
V případě odstoupení od smlouvy nese kupující náklady na dopravu vráceného zboží zpět prodávajícímu a to i v tom případě, kdy zboží nemůže být vráceno pro svou povahu obvyklou poštovní cestou.

4.5.
Odstoupí-li kupující od kupní smlouvy, vrátí prodávající peněžní prostředky přijaté od kupujícího (kromě částky, která představuje dodatečné náklady na dodání zboží vzniklé v důsledku kupujícím zvoleného způsobu dodání zboží, který je jiný než nejlevnější způsob standardního dodání zboží nabízený prodávajícím) do 14 dnů od odstoupení od kupní smlouvy kupujícím, a to stejným způsobem, jakým je prodávající od kupujícího přijal. Prodávající si však vyhrazuje právo pozdržet vrácení kupní ceny do doby vrácení zboží ve smyslu čl. 4.7., věta druhá.

4.6.
Kupující bere na vědomí, že pokud zboží vrácené kupujícím bude poškozeno, opotřebeno či částečně spotřebováno, vzniká prodávajícímu vůči kupujícímu nárok na náhradu škody jemu tím vzniklé. Nárok na úhradu vzniklé škody je prodávající oprávněn jednostranně započíst proti nároku kupujícího na vrácení kupní ceny.

4.7.
Do doby převzetí zboží kupujícím je prodávající oprávněn kdykoliv od kupní smlouvy odstoupit. V takovém případě vrátí prodávající kupujícímu kupní cenu bez zbytečného odkladu, a to bezhotovostně na účet určený kupujícím.

4.8.
Je-li společně se zbožím poskytnut kupujícímu dárek, je darovací smlouva mezi prodávajícím a kupujícím uzavřena s rozvazovací podmínkou, že dojde-li k odstoupení od kupní smlouvy kupujícím, pozbývá darovací smlouva ohledně takového dárku účinnosti a kupující je povinen spolu se zbožím prodávajícímu vrátit i poskytnutý dárek.

4.9.
V případě, že kupující uhradil peněžní prostředky hotově při převzetí zboží, kupující výslovně souhlasí, aby mu prodávající při odstoupení od kupní smlouvu odeslal částku bankovním převodem.

4.10.
V případě, že byla úhrada provedena s použitím dárkového poukazu, kupující výslovně souhlasí, aby se vrácení finanční částky provedlo formou kreditu, který mu bude vystaven buď prodejcem na prodejně nebo dodatečně zaslán na emailovou adresu kupujícího.
5. TRANSPORTATION AND DELIVERY OF GOODS

5.1.
The method of goods delivery is determined when the goods are ordered. Where the method of transportation is agreed on the basis of the Purchaser’s special request, the Purchaser shall bear the risk and potential additional costs incurred in connection with such method of transportation.

5.2.
Where the Seller is obliged to deliver the goods pursuant to the Purchase Agreement to the place designated by the Purchaser in the Order, the Purchaser shall be obliged to take over the goods upon the delivery.

5.3.
Where it is necessary on grounds on the part of the Purchaser that the goods are delivered repeatedly or in a manner other than that stated in the Order, the Purchaser shall be obliged to pay the costs incurred with the repeated delivery of the goods or the costs incurred in connection with such another method of delivery.

5.4.
Where the goods are taken over from the carrier the Purchaser shall be obliged to check whether the goods packaging is intact, and should any defects be discovered, the Purchaser shall be obliged to immediately inform the carrier of such fact (i.e. the person that delivered the goods from which the Purchaser took over the goods). If the packaging is tampered in any way showing unauthorized penetration into the consignment, the Purchaser does not have to take over the consignment from the carrier. The Purchaser confirms by its signature affixed to the delivery bill or to the confirmation of the goods takeover that the packaging of the consignment containing the goods is intact.

5.5.
The risk of damage to the goods passes to the Purchaser by the takeover of the item; the fact that the Purchaser did not take over the item has the same consequence, even if the Seller allowed that the Purchaser may handle the item and the Purchaser breached the Purchase Agreement by not taking over the goods.

5.6.
Other rights and obligations of the parties during the goods transportation may be stipulated by the Seller’s special delivery conditions if such conditions were issued by the Seller.
5. PŘEPRAVA A DODÁNÍ ZBOŽÍ

5.1.
Způsob doručení zboží se provádí v průběhu objednávání zboží. V případě, že je způsob dopravy smluven na základě zvláštního požadavku kupujícího, nese kupující riziko a případné dodatečné náklady spojené s tímto způsobem dopravy.

5.2.
Je-li prodávající podle kupní smlouvy povinen dodat zboží na místo určené kupujícím v objednávce, je kupující povinen převzít zboží při dodání.

5.3.
V případě, že je z důvodů na straně kupujícího nutno zboží doručovat opakovaně nebo jiným způsobem, než bylo uvedeno v objednávce, je kupující povinen uhradit náklady spojené s opakovaným doručováním zboží, resp. náklady spojené s jiným způsobem doručení.

5.4.
Při převzetí zboží od přepravce je kupující povinen zkontrolovat neporušenost obalů zboží a v případě jakýchkoliv závad toto neprodleně oznámit přepravci (tj. doručovateli zboží, od kterého jej přebírá). V případě shledání porušení obalu svědčícího o neoprávněném vniknutí do zásilky nemusí kupující zásilku od přepravce převzít. Podpisem dodacího listu, resp. potvrzení o převzetí zboží kupující stvrzuje, že obal zásilky obsahující zboží byl neporušen.

5.5.
Nebezpečí škody za zboží přechází na kupujícího převzetím věci; týž následek má, nepřevezme-li kupující věc, ač mu s ní prodávající umožnil nakládat a kupující poruší kupní smlouvu tím, že zboží nepřevezme.

5.6.
Další práva a povinnosti stran při přepravě zboží mohou upravit zvláštní dodací podmínky prodávajícího, jsou-li prodávajícím vydány.
6. RIGHT ARISING FROM DEFECTIVE PERFORMANCE

6.1.
The Purchaser is entitled to exercise the right arising from the goods defects discovered within 12 months following the takeover. The Purchaser has no right arising from the defective performance if the Purchaser was aware before the goods takeover that the goods were defective or if the Purchaser itself caused the goods defect.

6.2.
The Seller shall be liable vis-à-vis the Purchaser that the sold item complies with the Purchase Agreement. Compliance with the Purchase Agreement means that the quality and use qualities of the sold item correspond with the requirements of the agreement and were described by the Seller, manufacturer or its representative or expected on the basis of the advertising performed by them, or, as the case may be, that the quality and use qualities are typical of an item of such character, that it corresponds with the requirements of legal regulations, is in the appropriate quantity, size or weight and corresponds with the purpose stated by the Seller for the use of the item or for what the item is typically used.

6.3.
In the event that the goods have a defect which constitutes a significant breach of the purchase agreement and the goods were used, the Purchaser is entitled to request, at its own discretion (i) that the defect is removed by a repair of the goods or (ii) reasonable discount on the purchase price or (iii) rescission of the agreement. Should the goods have a defect the nature of which constitutes a non-significant breach of the agreement, the Purchaser has the right that the defect is removed or to receive a reasonable discount on the purchase price of the goods. The Purchaser, in place of the defect removal, can request a reasonable discount on the purchase price or rescission of the Purchase Agreement, if the Seller fails to remove the defect on time or rejects to remove the defect if the defect cannot be removed, or, as the case may be, if it cannot use the goods due to a repeated occurrence of the defect after the repair or due to a great number of defects.

6.4.
In the case of goods sold at a lower price, the provisions set out in Articles 6.1 and 6.2 of the Business Conditions do not apply to a defect due to which the lower price was agreed, to goods wear and tear caused by their standard use, in the case of used goods to a defect corresponding with the extent of the use or wear and tear of the goods existing upon the takeover thereof by the Purchaser or if it so results from the goods character.

6.5.
The rights arising from the liability for goods defects do not apply in particular to events where the defect or damage arose by: (i) mechanical damaging of the goods; (ii) natural disaster; (iii) demonstrably incorrect use; (iv) use in conflict with the instructions for use or instructions stated on the packaging; (v) use in a way contrary to generally known rules of use; (vi) demonstrably by using under conditions that do not correspond (by their temperature, dustiness, humidity or chemical and mechanical effects) with the environment that is directly determined by the manufacturer or that unambiguously results from the nature of the matter; or (vii) by demonstrably unprofessional operation. The rights from defective performance are exercised by the Purchaser at the Seller at the address set out in Article 6.14. The consumer may raise a complaint at a person appointed by the Seller. Where the complaint is handled by a person appointed by the Seller, such person may only handle the complaint by handing over repaired goods, otherwise, the complaint is referred to the Seller to be handled.

6.6.
The Purchaser shall be obliged to prepare the goods in respect of which the complaint was raised for transportation so that the goods are not damaged during the transportation and is also obliged to mark the goods according to its character (fragile, etc.). The risk of damage to the item shall be borne by the Purchaser until it is delivered to the Seller. The Purchaser shall also be obliged to describe in writing how the defect manifests itself (including the way in which the defect occurred).

6.7.
The Purchaser shall be obliged to deliver the goods in respect of which the complaint was raised to the Seller clean (clothing washed, shoes cleaned but not washed).

6.8.
The Seller shall be obliged to provide a written confirmation to the Purchaser on when the Purchaser exercised the right from liability for defects, on the contents of the complaint and on what method of the complaint handling is requested by the Purchaser, as well as a confirmation on the date and method of the complaint handling, including a confirmation that the repair was carried out and the duration thereof, and, as the case may be, a written justification of dismissing the complaint.

6.9.
The Seller or a person authorized by the Seller will decide on the complaint immediately, in complicated cases within three business days. Said period does not include the period that is commensurate to the kind of the product or services necessary for a professional assessment of the defect. The complaint, including the defect removal, must be handled without delay, no later than within 30 days following the day when the complaint was raised, unless the Seller and the Purchaser agree on a longer period. Expiration of such period to no avail is considered as a significant breach of the agreement and the Purchaser is entitled to rescind the Purchase Agreement.

6.10.
The Seller shall inform the Purchaser by e-mail of the result of the complaint handling.

6.11.
The moment when the complaint was raised is the moment when the Seller received the goods in respect of which the complaint was raised from the Purchaser together with the demonstration of the Purchaser’s will.

6.12.
Where the goods in respect of which the complaint was raised are sent to the Seller, the date when the complaint was received is the day when the last part of the goods was received by the Seller. The day when the complaint was handled is the day when the Purchaser – consumer was informed by the Seller of the method of handling the complaint.

6.13.
No guarantee or liability for defects beyond the framework of the law may not be applied to any gifts that the Seller provides free of charge to the Purchaser under the Purchase Agreement on other paid-for goods.

6.14.

6. PRÁVA Z VADNÉHO PLNĚNÍ

6.1.
Kupující je oprávněn uplatnit právo z vady zboží, které se na zboží vyskytne v době 12 měsíců od převzetí. Právo z vadného plnění kupujícímu nenáleží, pokud kupující před převzetím zboží věděl, že zboží má vadu nebo vadu zboží sám způsobil.

6.2.
Prodávající odpovídá kupujícímu za to, že prodávaná věc je ve shodě s kupní smlouvou. Shodou s kupní smlouvou se rozumí, že prodávaná věc má jakost a užitné vlastnosti smlouvou požadované, prodávajícím, výrobcem nebo jeho zástupcem popisované, nebo na základě jimi prováděné reklamy očekávané, popřípadě jakost a užitné vlastnosti pro věc takového druhu obvyklé, že odpovídá požadavkům právních předpisů, je v tom odpovídajícím množství, míře nebo hmotnosti a odpovídá účelu, který prodávající pro použití věci uvádí nebo pro který se věc obvykle používá.

6.3.
V případě, že zboží vykazuje vadu, která svou povahou představuje podstatné porušení kupní smlouvy, a jde o věc použitou, je kupující oprávněn žádat dle vlastního uvážení buď (i) odstranění vady opravou zboží nebo (ii) přiměřenou slevu z kupní ceny nebo (iii) odstoupit od smlouvy. Jestliže zboží vykazuje vadu, která svou povahou představuje nepodstatné porušení smlouvy, má kupující právo na odstranění vady, anebo na přiměřenou slevu z kupní ceny zboží. Kupující může namísto odstranění vady požadovat přiměřenou slevu z kupní ceny nebo od kupní smlouvy odstoupit, neodstraní-li prodávající vadu včas nebo ji odmítne odstranit, je-li vada neodstranitelná, popř. pokud nemůže zboží užívat pro opakovaný výskyt vady po opravě nebo větší počet vad.

6.4.
Ustanovení uvedená v čl. 6.1 a 6.2. obchodních podmínek se nepoužijí u zboží prodávaného za nižší cenu na vadu, pro kterou byla nižší cena ujednána, na opotřebení zboží způsobené jeho obvyklým užíváním, u použitého zboží na vadu odpovídající míře používání nebo opotřebení, kterou zboží mělo při převzetí kupujícím, nebo vyplývá-li to z povahy zboží.

6.5.
Práva z odpovědnosti za vady zboží se nevztahují zejména na případy, kdy závada nebo poškození vznikla: (i) mechanickým poškozením zboží, (ii) živelnou katastrofou, (iii) prokazatelně nesprávným užíváním, (iv) užíváním v rozporu s návodem k použití nebo pokyny uvedenými na obalu, (v) užíváním v rozporu s obecně známými pravidly užívání, (vi) prokazatelně používáním v podmínkách, které neodpovídají (svojí teplotou, prašností, vlhkostí, chemickými a mechanickými vlivy prostředí, které je přímo výrobcem určeno nebo které jednoznačně vyplývá z povahy věci, (vii) prokazatelně neodbornou obsluhou. Práva z vadného plnění uplatňuje kupující u prodávajícího na adrese uvedené v čl. 6.14. Spotřebitel může reklamaci uplatnit i u osoby určené prodávajícím. Pokud reklamaci spotřebitele vyřizuje osoba určená prodávajícím, tato může reklamaci vyřídit pouze předáním opraveného zboží, jinak reklamaci postoupí k vyřízení prodávajícímu.

6.6.
Kupující je povinen reklamované zboží připravit k přepravě tak, aby při ní nedošlo k poškození zboží a je také povinen zboží označit dle jeho povahy (křehké atd.). Nebezpečí škody na věci nese až do jejího doručení prodávajícímu kupující. Kupující je povinen současně písemně popsat, jak se vada projevuje (příp. i jak vznikla).

6.7.
Kupující je povinen reklamované zboží dodat prodávajícímu čisté (oděvy vyprané, obuv vyčištěná, naopak ale ne praná).

6.8.
Prodávající je povinen kupujícímu vydat písemné potvrzení o tom, kdy kupující právo z odpovědnosti za vady uplatnil, co je obsahem reklamace a jaký způsob vyřízení reklamace kupující požaduje, jakož i potvrzení o datu a způsobu vyřízení reklamace, včetně potvrzení o provedení opravy a době jejího trvání, případně písemné odůvodnění zamítnutí reklamace.

6.9.
Prodávající nebo jím pověřený pracovník rozhodne o reklamaci ihned, ve složitých případech do tří pracovních dnů. Do této lhůty se nezapočítává doba přiměřená podle druhu výrobku či služby potřebná k odbornému posouzení vady. Reklamace včetně odstranění vady musí být vyřízena bezodkladně, nejpozději do 30 dnů ode dne uplatnění reklamace, pokud se prodávající s kupujícím nedohodne na delší lhůtě. Marné uplynutí této lhůty se považuje za podstatné porušení smlouvy a kupující má právo od kupní smlouvy odstoupit.

6.10.
O výsledku vyřízení reklamace informuje prodávající kupujícího e-mailem.

6.11.
Za okamžik uplatnění reklamace se považuje okamžik, kdy prodávající obdržel od kupujícího reklamované zboží společně s projevem vůle kupujícího.

6.12.
V případě zasílání reklamovaného zboží prodávajícímu se za den přijetí reklamace považuje den obdržení poslední součásti zboží prodávajícím. Za den vyřízení reklamace se považuje den vyrozumění kupujícího – spotřebitele prodávajícím o způsobu vyřízení reklamace.

6.13.
Na dárky, které prodávající poskytuje kupujícímu bezplatně v rámci kupní smlouvy na jiné placené zboží, nelze uplatnit záruku ani odpovědnost za vady nad rámec zákona.

6.14.
Zasílací adresa pro veškeré reklamace a adresa, kde lze uplatnit reklamaci a odevzdat reklamované zboží je: Pod Harfou 994/21, 190 00 Praha 9, Česká Republika.
7. OTHER RIGHTS AND OBLIGATIONS OF THE PARTIES

7.1.
The Purchaser takes into account that the software and other parts constituting the Shop Web Interface (including photographs of the goods offered) are protected by copyright. The Purchaser undertakes to refrain from performing any activities that could enable to the Purchaser or any third parties to unrightfully interfere with or unrightfully use the software or any other parts constituting the Shop Web Interface.

7.2.
When using the Shop Web Interface, the Purchaser is not entitled to use any mechanisms, software or any other procedures that might negatively affect the operation of the Shop Web Interface. The Shop Web Interface may only be used in the extent that does not infringe the rights of the other customers of the Seller and that is in compliance with its purpose.

7.3.
The Seller is not bound in releation to the Purchaser by any code of conduct pursuant to the provisions of Section 1826(1)(e) of the Civil Code.

7.4.
The Purchaser takes into account that the Seller is not liable for any errors occurring as a result of third-party interference with the Website or as a result of using the Website in conflict with its purpose.

7.5.
Consumers’ complaints are handled by the Seller via the electronic address info@wearnormcode.com. The Seller shall send the information on handling the Purchaser’s complaint to the Purchaser’s electronic address.

7.6.
The Seller is authorized to sell the goods on the basis of a Trade Authorization. The inspection of the activities performed under the Trade Licence is performed by the Trade Licensing Office within the framework of its competence. The supervision of the personal data protection is performed by the Personal Data Protection Office. The Czech Trade Inspectorate supervises in the specified extent the compliance with Act No. 634/1992, Coll., on the Consumer Protection, as amended.

7.7.
The Purchaser hereby assumes the risk of a change of the circumstances pursuant to Section 1765(2) of the Civil Code.
7. DALŠÍ PRÁVA A POVINNOSTI SMLUVNÍCH STRAN

7.1.
Kupující bere na vědomí, že programové vybavení a další součásti tvořící webové rozhraní obchodu (včetně fotografií nabízeného zboží) jsou chráněny autorským právem. Kupující se zavazuje, že nebude vykonávat žádnou činnost, která by mohla jemu nebo třetím osobám umožnit neoprávněně zasahovat či neoprávněně užít programové vybavení nebo další součásti tvořící webové rozhraní obchodu.

7.2.
Kupující není oprávněn při využívání webového rozhraní obchodu používat mechanismy, programové vybavení nebo jiné postupy, které by mohly mít negativní vliv na provoz webového rozhraní obchodu. Webové rozhraní obchodu je možné užívat jen v rozsahu, který není na úkor práv ostatních zákazníků prodávajícího a který je v souladu s jeho určením.

7.3.
Prodávající není ve vztahu ke kupujícímu vázán žádnými kodexy chování ve smyslu ustanovení § 1826 odst. 1 písm. e) občanského zákoníku.

7.4.
Kupující bere na vědomí, že prodávající nenese odpovědnost za chyby vzniklé v důsledku zásahů třetích osob do webové stránky nebo v důsledku užití webové stránky v rozporu s jejich určením.

7.5.
Vyřizování stížností spotřebitelů zajišťuje prodávající prostřednictvím elektronické adresy info@wearnormcode.com. Informaci o vyřízení stížnosti kupujícího zašle prodávající na elektronickou adresu kupujícího.

7.6.
Prodávající je oprávněn k prodeji zboží na základě živnostenského oprávnění. Živnostenskou kontrolu provádí v rámci své působnosti příslušný živnostenský úřad. Dozor nad oblastí ochrany osobních údajů vykonává Úřad pro ochranu osobních údajů. Česká obchodní inspekce vykonává ve vymezeném rozsahu mimo jiné dozor nad dodržováním zákona č. 634/1992 Sb., o ochraně spotřebitele, ve znění pozdějších předpisů.

7.7.
Kupující tímto přebírá na sebe nebezpečí změny okolností ve smyslu § 1765 odst. 2 občanského zákoníku.
8. DELIVERY

8.1.
Unless agreed otherwise, the parties may deliver all written correspondence by electronic mail to the e-mail address stated by the Purchaser in the Order or to the address stated on the Seller’s Website.

8.2.
A message the takeover of which was rejected by the addressee and which was not collected within the deposit period or which was returned as undeliverable shall also be considered delivered.
8. DORUČOVÁNÍ

8.1.
Nebude-li dohodnuto jinak, smluvní strany si mohou veškerou písemnou korespondenci vzájemně doručovat prostřednictvím elektronické pošty, a to na adresu elektronické pošty uvedenou kupujícím v objednávce, resp. na adresu uvedenou na webové stránce prodávajícího.

8.2.
Za doručené se považuje i oznámení, jehož převzetí bylo adresátem odmítnuto, které nebylo vyzvednuto v úložní době, nebo které se vrátilo jako nedoručitelné.
9. FINAL PROVISIONS

9.1.
If the GoPay payment gateway is used provided by GoPay s.r.o., Planá 67, Planá, postal code 370 01, Czech Republic, Identification No. (IČ): 26046768 or if Zásilkovna service is used provided by Zásilkovna s. r. o., with its registered office at Muchovo náměstí 3624/8, Bratislava, postal code 851 01, Identification No. (IČO): 48136999, the conditions of such service shall be applied; certain transactions may be subject to charge. When using such services, the Purchaser by clicking the button “Proceed to Payment” expresses its consent to such conditions and authorizes the Seller to obtain information (including the data on its payment card) and for the provision thereof by such services provider.

9.2.
Should any provision of these Business Conditions be or become invalid or ineffective, provisions the sense of which is as close as possible to the invalid provisions shall be applied in place of the invalid provisions. The invalidity or ineffectiveness of such provisions shall be without prejudice to the validity of the remaining provisions. Any changes and supplements to the Purchase Agreement or to the Business Conditions must be in writing (the written form is also necessary for communication pursuant to Article 8.1).

9.3.
The Purchase Agreement, including these Business Conditions, shall be archived by the Seller in the electronic form and is not available.

9.4.
Should any relationship connected with the use of the Website or a legal relationship established by the Purchase Agreement contain any international (foreign) element, the parties agree that such relationship shall be governed by Czech law. This provision is without prejudice to the consumer’s rights arising from generally binding legal regulations. Potential ldisputes may also be resolved by out-of-court settlement.

9.5.
Should any consumer dispute arise between the Seller and the Purchaser (consumer) from the Purchase Agreement and it is impossible to resolve such dispute amicably, the consumer may submit an application for out-of-curt settlement of such dispute. Consumer disputes arising from the Purchase Agreement will be resolved extrajudicially by the Czech Trade Inspectorate, with its registered office at Štěpánská 567/15, Prague 2, postal code 120 00, Identification No. (IČ): 000 20 869, Internet address: http://www.coi.cz ČOI. Consumers may also use the online dispute resolution platform established by the European Commission at http://ec.europa.eu/consumers/odr/.

9.6.
The Seller recommends that the Purchaser at first uses the contact address info@wearnormcode.com to resolve a particular situation.
These Business Conditions take effect on 01/03/2021.
9. ZÁVĚREČNÁ USTANOVENÍ

9.1.
V případě využití služby platební brány GoPay, kterou poskytuje společnost GoPay s.r.o., Planá 67, 370 01 Planá, Česká republika, IČ: 26046768 nebo službu Zásilkovna, kterou poskytuje společnost Zásilkovna s. r. o., se sídlem Muchovo náměstí 3624/8, 851 01 Bratislava, IČO: 48136999, na tyto vztahy se použijí podmínky těchto služeb, přičemž některé transakce mohou být zpoplatněny. V případě využití těchto služeb Kliknutím na tlačítko "Proceed to payment" kupující projevuje souhlas s těmito podmínkami a zmocňuje Prodávajícího k získávání informací (včetně údajů o jeho platební kartě) a na jejich poskytnutí provozovatelem těchto služeb.

9.2.
Je-li některé ustanovení obchodních podmínek neplatné nebo neúčinné, nebo se takovým stane, namísto neplatných ustanovení nastoupí ustanovení, jehož smysl se neplatnému ustanovení co nejvíce přibližuje. Neplatností nebo neúčinností takového ustanovení není dotknutá platnost ostatních ustanovení. Změny a doplňky kupní smlouvy či obchodních podmínek vyžadují písemnou formu (písemná forma je zachována i komunikací podle čl. 8.1).

9.3.
Kupní smlouva včetně obchodních podmínek je archivována prodávajícím v elektronické podobě a není přístupná.

9.4.
Pokud vztah související s užitím webové stránky nebo právní vztah založený kupní smlouvou obsahuje mezinárodní (zahraniční) prvek, pak strany sjednávají, že vztah se řídí českým právem. Tímto nejsou dotčena práva spotřebitele vyplývající z obecně závazných právních předpisů. Případné spory lze řešit také mimosoudní cestou.

9.5.
V případě, že dojde mezi prodávajícím a kupujícím (spotřebitelem) ke vzniku spotřebitelského sporu z kupní smlouvy, který se nepodaří vyřešit vzájemnou dohodou, může spotřebitel podat návrh na mimosoudní řešení takového sporu. K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, se sídlem Štěpánská 567/15, 120 00 Praha 2, IČ: 000 20 869, internetová adresa: http://www.coi.cz ČOI. Spotřebitel může využít rovněž platformu pro řešení sporů online, která je zřízena Evropskou komisí na adrese http://ec.europa.eu/consumers/odr/.

9.6.
Prodávající doporučuje kupujícímu pro vyřešení nastalé situace nejdříve využít kontakt info@wearnormcode.com. Tyto obchodní podmínky nabývají účinnosti dne 01/03/2021.
